Petalibrary Terms of Service

Use of and access to the Ƶ18 “PetaLibrary” research data storage service is conditional on the following requirements. Failure to adhere to these terms may result in loss of access, including loss of access to data, without prior notification.

Responsibilities

  • The PetaLibrary allocation owner is responsible for ensuring that use of their PetaLibrary allocation(s) is in full compliance with these terms and any other applicable laws or regulations.
  • The PetaLibrary allocation owner is responsible for ensuring full compliance with any applicable Institutional Review Board (IRB) requirements governing the storage or use of any data stored in their PetaLibrary allocation(s).
  • The PetaLibrary allocation owner is responsible for ensuring that they remain informed of and in compliance with changes to these terms and any applicable laws, policies or circumstances.
  • The PetaLibrary allocation owner is responsible for ensuring that any additional users authorized for access to their PetaLibrary allocation(s) act in full compliance with these terms.
  • The PetaLibrary allocation owner is responsible for ensuring timely payment for their PetaLibrary allocation(s), and is subject to the in the event that billing is past due.

Limitations

  • The PetaLibrary may not be used to store any data that is US government Classified, nor any Controlled Unclassified Information including, but not limited to, data subject to the US federal Health Insurance Portability and Accountability Act (HIPAA), the US federal Family Educational Rights and Privacy Act (FERPA), or the International Traffic in Arms Regulations (ITAR).
  • The PetaLibrary may not be used for any purpose in violation of CU System, CU Boulder, or CU Boulder Office of Information Technology (OIT) policy. The PetaLibrary may not be used to store or distribute any data in violation of copyright law.
  • The PetaLibrary is intended to store “research data,” defined here to include any data that is a direct component of the academic mission of the University or its authorized partners. Appropriate use includes, but is not limited to, data gathered by university core facilities and other research instruments; data used or generated by RC compute facilities; software executed by RC compute facilities; data used or for use in an academic publication, and data supporting classroom instruction. Inappropriate use includes, but is not limited to, full backups of individual workstationsand storage of personal data or media. Research Computing reserves the right to charge a full, non-subsidized rate for the full size of PetaLibrary allocations storing non-research data.

Reliability and continuity

  • A PetaLibrary active or archive allocation on its own is a single copy of your data that is not backup. The PetaLibrary allocation owner is solely responsible for ensuring critical data are backed up.
  • The PetaLibrary service, including access to or retrieval of data previously stored, is contingent on continued funding and support by Ƶ18. The University provides the PetaLibrary service on an “as-is” basis. While every reasonable and good faith effort will be made to ensure the reliability and availability of the PetaLibrary and of the data stored on it, neither Ƶ18 nor Research Computing make any guarantees with respect to its reliability or continued availability.
  • In the event that Research Computing or the University ceases to provide the PetaLibrary or any comparable resource, neither Research Computing nor the University assume any responsibility for transferring any data stored on the PetaLibrary to an alternate storage resource.
  • Neither Research Computing nor the University assume any responsibility for assuring the fitness of any “backup” or replication of data, including but not limited to “backup” or replication services provided as part of the PetaLibrary itself.
